What personal information is being processed and what for

Information processed will include your name, address, telephone number and e-mail address. Personal information such as your signature and contact details (if applicable) will be redacted before being published or displayed. 

Why we are allowed to use your information

Cheshire East Council is required under the Commons Act 2006 to perform the duties of a Commons Registration Authority, in accordance with the Commons Registration (England) Regulations 2014.  

Who we will share your information with

Access to your information will be made to authorised members of staff who are required to process it for the purposes outlined in this privacy notice.

We are also required to share your information when we formally display applications via public notices and make them available to the general public, and with others who have requested sight of your representation and/or supporting documentation. Landowner details, and rights of common have to be displayed via formal Common Land and Town or Village Green registers and be accessible to members of the public. Additionally landowner statements made under Section 15A are displayed in the register maintained by the service and published online.

Where we get your information from

Personal information is given through communications between you and the Property Information team including through applications and enquiries.  In addition, information on landowners and occupiers is obtained from office records and the Land Registry.

How long we will keep your personal information

Your information will be kept up to seven years after the decision of the application has been made. Thereafter the application and decision are permanently retained and available for public inspection. 

How your information is stored

Whilst your data is processed by Cheshire East Council, your data will be held within its secure network and premises and will not be processed outside of the UK.   

What happens if you don’t provide us with your information

Name and address information, and signatures, are necessary to validate applications and representations as set out in legislation and regulation.  If they are not provided the applications are classed as void.

Will your information be used to make automated decisions

No. 

Your rights

You have a number of rights regarding your personal data, including withdrawing your consent where we have asked for it. You can also ask for a copy of the information we hold about you and ask us to correct anything that is wrong.
