Vapes and the single-use ban
A single-use vape is a vape which is not intended to be re-used.
From 1 June 2025 it will be illegal to sell single-use (disposable) vapes under The Environmental Protection (Single-use Vapes) (England) Regulations 2024.
Disposable vapes waste valuable resources and are often discarded improperly, releasing harmful substances into the environment and posing fire hazards if they end up in landfills.
Selling vapes
From 1 June any vapes you sell must:
- be rechargeable
- be refillable with e-liquid
- have a replaceable coil.
If you sell single use vapes after 1 June 2025, you will be committing a criminal offence and could be liable to enforcement action.
What you need to do
Before the ban comes into place, you need to check that the vapes you stock meet the requirements. If you have any leftover single use vaping products on 1 June 2025 you need to:
- separate them from other goods,
- label them as ‘NOT FOR SALE’,
- remove them from your shopfloor or online store until they’ve been collected by a registered vape recycling service.

Enforcement action
If a person, operating as a business, supplies a single-use vape they commit a criminal offence. Supply includes giving such vapes away.
We may take legal action against a person who supplies, offers to supply or possesses for supply, a single-use vape.
Cheshire East Council is a regulator for the purposes of enforcing the Environmental Protection (Single-use Vapes) (England) Regulations 2024.
