Building Safety Levy

The Building Safety Levy is a government charge that applies to some new residential developments in England. The money collected helps fund improvements to building safety in existing residential buildings.

The developer must confirm whether the Building Safety Levy applies and is responsible for paying the levy.

Who must pay the levy?

You may need to pay the levy if you are carrying out a qualifying residential development, including:

• new housing developments
• purpose-built student accommodation
• other residential developments covered by the Building Safety Levy regulations

The levy applies to all eligible applications and resubmissions submitted on or after 1 October 2026.

Some developments do not need to pay the levy, including certain affordable housing and social housing schemes.

How the levy is paid

If your development is subject to the levy, you will need to submit all of the relevant information on your building control submission so that we can calculate the charge accurately. We will then send you a Building Safety Levy Liability Notice which will confirm:

• whether the levy applies to your development
• how much you need to pay
• how and when to make your payment

You must pay the levy before the development can be completed.

Once we have received your payment, we will issue a Building Safety Levy Payment Certificate.
