What personal information is being processed and what for

The Compliance and Customer Relations team collects personally identifiable information whenever you request information, make a complaint, (including in relation to children) or provide feedback.

This information may include your name, email address, home or work address, telephone or mobile number, date of birth, personal preferences or bank account details. It may also include sensitive personal information classed as Special Category data when it is relevant to your communication, for example, regarding your health. 

Why we are allowed to use your information

This information is collected where it is our legal obligation to do so, including under the:

  • Freedom of Information Act 2000
  • Data Protection Act 2018
  • General Data Protection Regulation
  • Environmental Information Regulations 2004 
  • The Children’s Act 1989 Representations Procedure (England)
  • Local Government Act 1974
  • Regulation of Investigatory Powers Act 2000

Where you provide us with information beyond the scope of these legal obligations, we will not process this without your consent.

Where you have provided information which we are holding because we have your consent, you have the right for this to be deleted at your request. 

Who we will share your information with

We will share this information with officers of Cheshire East Council involved in your case or who are responding to your complaint or request for information, and where appropriate, elected representatives, JP's , and other regulatory bodies such as the Local Government Ombudsman and Information Commissioner’s Office. 

Where we get your information from

Information held by our team will normally come from you, when you make a complaint or request for access to information or any other request regarding your data protection rights. In some cases, we may be provided with your data by a third party in relation to a request or complaint they have made.In dealing with your request we will access relevant information you have provided to other teams in the Council.

How long we will keep your personal information

We keep your information only for as long as is necessary to undertake our obligations.  Information relating to complaints and requests for information is generally held for three years after closure but full details of the retention periods for different types of data are contained in the Council’s Information Asset Register.

How your information is stored?

All information provided to our team is kept on secure electronic systems. These are all only accessible to appropriate Cheshire East Council Officers, and secured by passwords and, where appropriate, encryption.  

What happens if you don’t provide us with your information?

Due to the nature of the work carried out by the Compliance & Customer Relations Team, we may not be able to assist you with your complaint or request if you do not provide us with the required information.  

Will your information be used to make automated decisions?

No

Your rights

You have a number of rights regarding your personal data, including withdrawing your consent where we have asked for it. You can also ask for a copy of the information we hold about you and ask us to correct anything that is wrong.
