Traffic regulation order - Glegg Street and Fountain Street, Macclesfield

Notice of making Cheshire East Borough Council (Glegg Street and Fountain Street, Macclesfield) (prohibition of waiting, on street permit parking – zone A2 and revocation) Order 2020

Notice is hereby given that on 18 March 2020 Cheshire East Borough Council made an Order under Sections 1, 2, 4, 32, 35, 45, 46, 49, 51, 53 and Parts III and IV of Schedule 9 of the Road Traffic Regulation Act 1984, as amended, and all other enabling powers and in accordance with its duty under Section 122 of the said Act.

  1. The effect of the Order, which will come into operation on 6th April 2020, will be to;

a) introduce parking places for permit holders only, between the hours of 8am and 6pm, Monday to Saturday, on the following lengths and sides of road;

Glegg Street, Macclesfield (south west side) - from a point 10 metres south east of its junction with Green Street for a distance of 18 metres in a south easterly direction.

b) introduce a prohibition of waiting by vehicles at all times on all days on the following lengths and sides of road;

Glegg Street, Macclesfield (north east side) - from a point 10 metres south east of its junction with Green Street to its junction with Daintry Street.

c) revoke that part of ‘The Cheshire East Borough Council (Green Street Area, Macclesfield) (Prohibition of Waiting, Limited Waiting Parking Place and On Street Permit Parking – Zone A2) Order 2019’ in so far as it relates to Limited Waiting Parking Places on the following lengths and sides of road

Fountain Street, Macclesfield (north east side) - from a point in line with the western boundary of No. 22 Fountain Street for a distance of 9 metres in a south easterly direction

Glegg Street, Macclesfield (south west side) - from a point 10 metres south east of its junction with Green Street for a distance of 18 metres in a south easterly direction.

Permits will cost £60 per annum for a resident’s permit, £10 per book of ten visitor scratch cards (first 4 books per annum discounted to £5 per book) and no charge for a carer’s permit

The class of vehicle in which a permit can be used is a motor vehicle within section 136(1) of the 1984 Act, with a maximum gross vehicle weight of 3.5 tonnes, be a vehicle that can carry no more than 13 people including the driver and it must not exceed 6 metres in length or 2.44 metres (8 ft) in height.

  1. Any person who desires to question the validity of the Order or any of its provisions on the grounds that it is not within the powers conferred by the Act, or any requirement of the Act or an instrument made under the Act has not been complied with, that person may, within 6 weeks from the date on which the Order is made, apply for the purpose to the High Court.
