Notice of making Cheshire East borough council (Green Street area, Macclesfield)

(prohibition of waiting, limited waiting parking place and on street permit parking – zone a2) order 2019

Notice is hereby given that on 12th September 2019 Cheshire East Borough Council made an Order under Sections 1, 2, 4, 32, 35, 45, 46, 49, 51, 53 and Part III of Schedule 9 of the Road Traffic Regulation Act 1984, as amended, and all other enabling powers and in accordance with its duty with Section 122 of the said Act.

1. The effect of the Order, which makes permanent the provisions of Cheshire East Borough Council (Green Street Area, Macclesfield)(Prohibition of Waiting, Limited Waiting Parking Place & On Street Permit Parking – Zone A2) Experimental Order 2018 and which will come into operation on 19th September 2019, will be to;

a) introduce parking places for permit holders only, between the hours of 8am and 6pm, Monday to Saturday, on the following lengths and sides of road;

  • Canal Street, Macclesfield (both sides) - from a point 5 metres east of its junction with Green Street in an easterly direction to its closed end
  • Daintry Street, Macclesfield (south east side) - from a point 11 metres north east of its junction with Brook Street in a north easterly direction to a point 10 metres south west of its junction with Glegg Street
  • Daintry Street, Macclesfield (north west side) - from a point 10 metres south west of its junction with Glegg Street in a south westerly direction for a distance of 26 metres
  • Flint Street, Macclesfield (south east side) - from a point in line with the southern boundary of No. 19 Flint Street in a north easterly direction to a point in line with the common boundary of No. 1 and 3 Flint Street
  • Fountain Street, Macclesfield (north east side) - from a point in line with the common boundary of No. 50 and 52 Fountain Street in a north westerly direction to a point in line with the western boundary of No. 22 Fountain Street
  • Fountain Street, Macclesfield (south west side) - from a point in line with the western boundary of No. 15 Fountain Street in a south easterly direction for a distance of 20 metres- from a point in line with the eastern boundary of No. 23 Fountain Street in a north westerly direction for a distance of 21 metres
  • Green Street, Macclesfield (east side) - from a point 10 metres north of its junction with Glegg Street in a northerly direction to a point 6 metres south of its junction with Canal Street- from a point 4.5 metres north of its junction with Canal Street in a northerly direction to a point 6 metres south of its junction with Fountain Street

b) introduce limited waiting parking places, 2 hours no return within 2 hours, between the hours of 8am and 6pm, Monday to Saturday, on the following lengths and sides of road;

  • Daintry Street, Macclesfield (north west side) - from a point 11 metres north east of its junction with Brook Street for a distance of 37 metres in a north easterly direction,
  • Glegg Street, Macclesfield (south west side) - from a point 10 metres north west of its junction with Daintry Street in a north westerly direction to a point 10 metres south east of its junction with Green Street,
  • Green Street, Macclesfield (east side) - from a point 11 metres south of its junction with Glegg Street in a southerly direction for a distance of 48.5 metres.

c) introduce a prohibition of waiting by vehicles at all times on all days on the following lengths and sides of road;

  • Brook Street, Macclesfield (north side) - from a point 10 metres west of its junction with Daintry Street to a point 10 metres east of said junction
  • Canal Street, Macclesfield (both sides) - from its junction with Green Street in an easterly direction for a distance of 5 metres
  • Daintry Street, Macclesfield (both sides) - from its junction with Brook Street in a north easterly direction for a distance of 11 metres,- from its junction with Glegg Street in a south westerly direction for a distance of 10 metres
  • Dale Street, Macclesfield (south side) - from its junction with Flint Street in an easterly direction for a distance of 5 metres
  • Flint Street, Macclesfield (south east side) - from its junction with Dale Street in a south westerly direction for a distance of 5 metres- from a point in line with the southern boundary of No. 19 Flint Street in a south westerly direction to its junction with Fountain Street
  • Flint Street, Macclesfield (north west side) - from its junction with Fountain Street in a north easterly direction for a distance of 33 metres
  • Fountain Street, Macclesfield (north east side) - from a point 5 metres west of its junction with Flint Street in a south easterly direction for a distance of 24 metres
  • Fountain Street, Macclesfield (both sides) - from its junction with Green Street in a south easterly direction for a distance of 5 metres
  • Glegg Street, Macclesfield (south west side) - from a point 10 metres north west of its junction with Daintry Street in a south easterly direction to a point 10 metres south east of said junction
  • Glegg Street, Macclesfield (both sides) - from its junction with Green Street in a south easterly direction for a distance of 10 metres
  • Green Street, Macclesfield (east side) - from a point 5 metres north of its junction with Fountain Street to a point 6 metres south of said junction - from a point 4.5 metres north of its junction with Canal Street to a point 6 metres south of said junction,- from a point 10 metres north of its junction with Glegg Street to a point 11 metres south of said junction,
  • Green Street, Macclesfield (both sides) - from a point 59.5 metres south of its junction with Glegg Street to its closed end including the turning head.

Permits will cost £60 per annum for a resident’s permit, £10 per book of ten visitor scratch cards (first 4 books per annum discounted to £5 per book) and no charge for a carer’s permit The class of vehicle in which a permit can be used is a motor vehicle within section 136(1) of the 1984 Act, with a maximum gross vehicle weight of 3.5 tonnes, be a vehicle that can carry no more than 13 people including the driver and it must not exceed 6 metres in length or 2.44 metres (8 ft) in height.

Any person who desires to question the validity of the Order or any of its provisions on the grounds that it or they are not within the powers conferred by the act, or that any requirement of the Act or any instrument made under the Act has not been complied with, within 6 weeks from the date on which the Order is made, apply for the purpose to the High Court.
