New Roads and Street Work Act
This page is intended to be used by utility companies and their
contractors to assist in the co-ordination of roadworks within the
Cheshire East region. The information contained is specific to the
implementation of the New Roads and Street Works Act -1991 and
Traffic Management Act - 2004 and is not aimed at the general
public.
General Information
The New Roads and Street Works Act and Traffic Management Act
have put a new emphasis on minimising disruption to the road user.
This involves sets of procedures that ensure all works are
'co-ordinated' to minimise possible disruption. Cheshire
East Council is the Highway Authority responsible for the
co-ordination of all roadworks on Cheshire
East roads.
Section 58 and 58A Schedules
Under Section 58 and 58A of the New Roads and Street Works Act
1991 (NRSWA), the execution of street works may be restricted for
periods of 6 months, 1 year, 3 years or 5 years respectively,
following the completion of substantial roadworks or
streetworks.
The aim is to provide an opportunity for utility companies to
carry out their works either before or during the works and prevent
future excavation to the newly laid road surface.
The following spreadsheets contain Section 58 and 58A Notice
information for the areas named. Subject to the exemptions of the
Act and Regulation under it, no street works may be executed for a
period of 6 months, 1 year, 3 years or 5 years
respectively without the written consent of Cheshire East
Council.
