Lasting power of attorney
You can give other people Lasting Power of Attorney
to make decisions over your money and/or your welfare (health and
social care); this allows you to choose people you trust to make
decisions on your behalf when you cannot make them for yourself.
The attorney’s power will only become valid and applicable at any
time your lose the capacity to make decisions for yourself.
Whoever you decide should have Lasting Power of Attorney has to
be registered with the Office of the Public Guardian, which will
make sure the powers aren’t being abused.
If you already have an Enduring Power of Attorney, you must also
register this with the Office of the Public Guardian for it to be
effective.
If you wish to make a Lasting Power of Attorney, you can do so
yourself with the packs available from the Office of the Public Guardian
website, or you can seek independent legal advice.
It costs £120 to register a Lasting Power of Attorney with the
Office of the Public Guardian. This could increase if you use a
solicitor as they will typically add their own costs and rates.
