Public notice - Poynton Compulsory Purchase Order

Cheshire East borough council important: this communication affects interests in property compulsory purchase of land and new rights in Stockport and Cheshire East located between the a 6 to Manchester airport relief road (A 6 MARR) (under construction) to the west of Poynton and the a 523 London Road to the south of Poynton the Cheshire East borough council and Stockport Metropolitan borough council (a 523 Poynton relief road) compulsory purchase order 2017 the highways act 1980 sections 8,239, 240, 246, 250 and 260 and the acquisition of land act 1981

Notice is hereby given that the Cheshire East Borough Council (the “acquiring authority”) has made the Cheshire East Borough Council and Stockport Metropolitan Borough Council (A523 Poynton Relief Road) Compulsory Purchase Order 2017 under sections 239, 240,246, 250 and 260 of the Highways Act 1980 and (to the extent that the order relates to land and new rights in the Metropolitan Borough of Stockport) under an agreement with Stockport Metropolitan Borough Council under section 8 of that Act.

It is about to submit this order to  the Secretary of State for Transport for confirmation, and if confirmed, the order will authorise the acquiring authority to purchase compulsorily, on behalf of both itself and Stockport Metropolitan Borough Council, the land and the new rights described below for the purpose of:

(1) the construction and improvement of the following highways in the area of the acquiring authority and in the Parish of Stockport in the Metropolitan Borough of Stockport:

(a) a new junction with the A6 to Manchester Airport Relief Road (under construction) at the Bramhall Oil Terminal Junction to the northwest of the A5149 Chester Road classified road (“the A6 MARR Junction”)

(b) a new road from the A6 MARR Junction travelling in a south-east direction under:

(i) a new bridge carrying the A514 Chester Road classified road

(ii) a new bridge providing a public right of way and access to the property known as Lostock hall Farm; and

(iii) a new bridge providing a public right of way and access to the property known as Shirdfold Farm,to a new roundabout to the west of the A523 London Road classified road (“the Southern Junction Roundabout”)

(c) a highway from the Southern Junction Roundabout travelling south-eastwards and then southwards to the A523 London Road classified road; together referred to as “the classified road”

(2) the improvement in the area of the acquiring authority of the A523 London Road classified road travelling south from the classified road

(a) to the north and south of its junction with Mill Lane to the west and Brookledge Lane to the east, together with improvements to those roads; and

(b) to the north and south of its junction with the B5358 Bonis Hall Lane to the west, together with improvements to that road.

(3) the construction and improvement of highways to connect the classified road to the existing road system

(a) at the A6 MARR Junction

(b) at the Southern Junction Roundabout; and

(c) the construction of other new highways and the improvement of existing highways in the vicinity of the route of the classified road,all in pursuance of the Cheshire East Borough Council and Stockport Metropolitan Borough Council (A523 Poynton Relief Road) (Classified Road) (Side Roads) Order 2017 (“the Side Roads Order”)

(4) the provision of new means of access to premises in pursuance of the Side Roads Order

(5) the construction of works for the drainage of the classified road and the new and improved highways

(6) the carrying out of works in non-navigable watercourses including an unnamed tributary of the watercourse known as the Red Brook in connection with the classified road and the new and improved highways

(7) mitigating the adverse effects which the existence of the highways proposed to be constructed or improved will have on the surroundings there of; and

(8) the use by the acquiring authority in connection with the construction and improvement of highways, the provision of new means of access and the mitigation of adverse effects

All interests other than those of the Metropolitan Borough Council of Stockport in various parcels and pieces of the golf course at Moorend Golf Course and Driving Range and pasture land, hedgerow and fence line located north east of Woodford Road (A5102) and south of the public right of way known as 14(a) HGB, north east of the property known as Walnut Tree Farm and north west of Chester Road (A5149) (Plots 1/1 and 1/1a).

The right to enter and re-enter with or without vehicles pasture land and hedgerow located north west of the property known as Walnut Tree Farm and east of Moorend Golf Course for all purposes connected with the diversion, maintenance and use of underground services (Plots 1/3d and 1/3g).
