A Tree Preservation Order (TPO) is
an order made by a Local Planning Authority (LPA) in respect of
trees.
A TPO can apply to a single tree,
group of trees or woodland but it cannot be applied to shrubs,
bushes or hedgerows (unless the hedge has become overgrown and now
reverts back to a row of trees).
The placement of a TPO does not
remove the duty of the owner to maintain a tree or carry out
regular inspections, including the costs of maintenance.
Any works to carry out tree surgery
or felling to a TPO tree must be approved by the Planning section,
except for several exemptions that can be found within the
regulations.
It is important not to confuse
trees protected by TPO with trees that are within
Conservation Areas as the regulations are
different but an application may still be required.
It is recommended that advice from a
qualified arboricultural contractor is sought when considering any
form of tree work; they should carry insurance and will also be
able to help fill in the application form.
