Planning Appeals
The Planning
Inspectorate handles appeals. This section provides
information about how and when to make a planning appeal, the
appeals procedure, and how to comment on and view appeals.
Planning appeals can be time consuming and
expensive. Before deciding to make an appeal it is advisable
to contact your local planning authority and speak to a planning
officer to find out if you can negotiate a compromise and submit a
revised application.
Since 6th April 2009 an expedited
Householder Appeals Service has been introduced which operates on
the basis of written representations. Householder appeals
must be made within 12 weeks from the date of the decision notice
and will be decided within eight weeks, six weeks quicker than the
previous system. For more information on householder appeals

If your appeal does not relate to a
householder development it must be made within six months of the
date of the decision notice.
Appeals can only be made by the applicant of
the original application. For information on the cost of an

When can you appeal?
You can make an appeal in the following
circumstances:
- If you applied for planning permission to
the Local Planning Authority (LPA) and they:
i) Refused permission
ii) Granted permission but attached conditions that you think
are inappropriate
iii) Haven’t approved the details of a scheme for which they
or the Secretary of State have already given outline
permission
iv) Have approved the details of a scheme but attached
conditions that you think are inappropriate
- If the LPA rejected a proposal arising from a
condition or limitation on a planning permission
- If the LPA do not make a decision on your
application within the time allowed, which is usually eight weeks
from the date when the application is valid
- If the LPA told you that they require further
information to make a decision on an outline application
but you do not want to provide this
