Development and Contaminated Land

Planning guidance states that on a precautionary basis any development site that is on or adjacent to previous industrial use and also for all sensitive end uses e.g. housing, schools, hospitals and children’s play areas.  The possibility of contamination should be assumed when considering development plans and individual planning applications.

Some sensitive end use applications now require certain information to be submitted with the application. For details of these applications and what information should be submitted for them please visit the Validation Checklist area of the website for Development Management.  Other applications may be on land which could be affected by historical contamination which could pose a constraint to redevelopment due to harmful effects on peoples health and the environment.

If your development requires some information to be submitted up front, you are advised to contact this section to discuss the exact requirements.  If the development is one listed below you are not aware of any historical issues then you may be able to simply complete one of the questionnaires which will suffice.  If the area has been subject to potentially contaminative activities then a full desk study is likely to be required.

The Local Planning Department will consult with the Contaminated Land Officer on all other applications and where it is deemed necessary a Contaminated Land Condition will be put on the application.

Both the validation checklist and the contaminated land condition have a staged approach to the investigation and remediation of the land. The first stage will ask for a desk top study and if this shows further investigation is required then an intrusive investigation will need to be undertaken and all remediation works will need to be validated by a suitably qualified engineer before the condition will be discharged.
