Notice of variation Cheshire East Borough Council (off-street parking places)

The Council hereby gives NOTICE in exercise of its powers under Section 35C of the Road Traffic Regulation Act 1984 and Regulation 25 of the Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996, of its intention to vary the current parking provisions and increase the tariff for the Pay and Display off-street car parks referred to in this Notice.

The proposed variations relate to the Cheshire East Borough Council (Off-Street Parking Places) Order (‘the Order’) which came into effect on 26th October 2015.

1) Teggs Nose Country Park Car Park, Buxton Old Road, Macclesfield, SK11 0AP  – Amend the existing Order to alter the charging period from 7 days per week between Easter Bank Holiday Friday to 31st October and Saturdays and Sundays throughout the year, to 7 days per week, each week of the year.

2) Increase the parking prices at both Teggs Nose Country Park Car Park and Brereton Heath Local Nature Reserve Car Park as follows.

3) Oak Street Car Park and the Civic Centre Car Park both in Crewe - Alter the parking provision at – A) Civic Centre Car Park to short stay only with the maximum stay being 4 hours and new shorter stay charges being introduced and B) on Oak Street Car Park reduce the charge for 1-2 hours from £1.10 to £1.00.

4) Spring Street Car Park in Wilmslow - Increase the maximum stay from 12 to 15 hours.

5) Rex Car Park, Wilmslow and Hoopers Car Park in Wilmslow - Allow for the use of either car park using a ticket purchased at the other. 

6) Wilmslow Leisure Centre Car Park - Reduce the maximum stay to 3 hours and amend the tariff to a single tariff of 3 hours (at the current 2 hour rate of £1.00) and remove the 2-5 hour tariff of £3.40.

7) South Street Car Park in Alderley Edge - Amend from 1 to 2 hours, the No Return enforcement provision. So that when a vehicle has been left in that parking place, the driver of the vehicle shall not within two hours of the expiry time of the maximum waiting time, permit the vehicle to wait again upon that parking place.

8) Oak Street Car Park, Wrexham Terrace Car Park, Gatefield Street Car Park and Wood Street East Car Park in Crewe: introduce long term parking permits at £460.00 for 12 months or £175.00 for 3 months.

To facilitate these variations, in the body of the Order there is to be inserted the following definitions:

‘Residents Parking Permit’ means a Parking Permit issued to a person who in the opinion of the Council fulfils the conditions of the Council’s Residents Parking Policy and any appropriate residency criterion

‘Approved Club’ means a proprietary or member’s club whose members regularly use facilities located at or close by to a Parking Place and which has been acknowledged and approved as such by the Council and ‘members of an Approved Club’ shall be construed accordingly

and in paragraph 11 after the words ‘the Driver of the Vehicle shall not within one hour of the Expiry Time’ add ‘(or such other time as is specified in the appropriate entry in the Schedule)’ together with further consequential changes to the wording of the Order for the sake of consistency.

The proposed variations above are intended to come into force on 1st April 2016. 

Restrictions for use and penalties for non-compliance with parking provisions otherwise remain the same as detailed within existing 

Order.Any objection or other representation relating to the proposed variations should be made in writing.
